These Affiliate Program Terms & Conditions (“Terms”) govern participation in the Hustle City Clothing Affiliate Program (“Program”). By applying to or participating in the Program, you (“Affiliate”) agree to be bound by these Terms, as well as our general Terms of Service and Privacy Policy, which are incorporated by reference.

1. 
   Eligibility and Enrollment
   
   Participation is subject to approval at the sole discretion of Hustle City Clothing (“we,” “us,” or “our”). We reserve the right to accept or reject any application for any reason or no reason and to revoke approval at any time. Affiliates must be at least 18 years old and legally able to enter into binding agreements.
   
2. 
   Affiliate Relationship
   
   Affiliates participate as independent contractors. Nothing in these Terms creates an employment relationship, partnership, joint venture, agency, or fiduciary relationship. Affiliates have no authority to bind Hustle City Clothing in any manner.
   
3. 
   Affiliate Links and Attribution
   
   Commissions are earned only on qualifying purchases properly tracked through a valid affiliate link issued by us. Attribution is determined solely by our internal tracking systems. We are not responsible for tracking failures caused by browser settings, ad blockers, cookie deletion, technical errors, or third-party interference.
   
4. 
   Commission Structure
   
   Commission rates, eligible products, qualifying actions, and attribution rules are determined solely by us and may be changed, limited, suspended, or terminated at any time without notice. Commissions are calculated based on the net amount actually received by Hustle City Clothing, excluding taxes, shipping, handling, discounts, refunds, chargebacks, canceled transactions, and fraudulent orders.
   
5. 
   Payment Terms
   
   Commissions are payable only after the applicable return, refund, and dispute period has closed and only if the Affiliate account remains in good standing. We reserve the right to withhold, delay, offset, adjust, or deny payments for suspected fraud, policy violations, accounting corrections, compliance reviews, or errors. Minimum payout thresholds may apply. We are not responsible for payment delays caused by incorrect or incomplete payment information provided by the Affiliate.
   
6. 
   Prohibited Conduct
   
   Affiliates may not:
   
   – Misrepresent Hustle City Clothing, its products, pricing, availability, or promotions
   
   – Use spam, deceptive, misleading, or unethical marketing practices
   
   – Bid on, register, or misuse Hustle City Clothing trademarks, brand names, or confusing variations without prior written consent
   
   – Use coupon, cashback, rebate, or incentive-based traffic unless expressly authorized in writing
   
   – Engage in self-referrals or transactions intended primarily to generate commissions
   
   – Violate any applicable laws, regulations, or third-party platform rules
   
7. 
   Intellectual Property
   
   We grant Affiliates a limited, non-exclusive, revocable license to use approved marketing materials solely in connection with the Program. All intellectual property rights remain the exclusive property of Hustle City Clothing. This license may be revoked at any time for any reason.
   
8. 
   Termination
   
   Either party may terminate participation in the Program at any time, with or without cause, effective immediately. Upon termination, all licenses granted under these Terms immediately cease. Any unpaid commissions may be forfeited if earned in violation of these Terms or subject to review at our discretion.
   
9. 
   Disclaimers
   
   The Program is provided “as is” and “as available.” We make no representations or guarantees regarding earnings, conversion rates, availability, or continued operation of the Program. Participation is at the Affiliate’s sole risk.
   
10. 
    Limitation of Liability
    
    To the maximum extent permitted by law, Hustle City Clothing shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, lost data, or loss of business, arising out of or related to participation in the Program. Our total liability shall not exceed the commissions paid to the Affiliate during the three (3) months immediately preceding the event giving rise to the claim.
    
11. 
    Indemnification
    
    Affiliate agrees to indemnify, defend, and hold harmless Hustle City Clothing from and against any claims, damages, liabilities, costs, and expenses arising out of or related to Affiliate’s participation in the Program, including any breach of these Terms or violation of applicable law.
    
12. 
    Modifications
    
    We reserve the right to modify, update, or replace these Terms at any time. Continued participation in the Program following any changes constitutes acceptance of the revised Terms.
    
13. 
    Governing Law
    
    These Terms shall be governed by and construed in accordance with the laws of the State of [STATE], without regard to conflict-of-law principles.
    
14. 
    Entire Agreement
    
    These Terms constitute the entire agreement between the parties regarding the Affiliate Program and supersede all prior or contemporaneous agreements or understandings.
